Preoperative informed consent is a legal and ethical requirement that ensures patients understand a procedure, its associated risks and benefits, alternative treatment options, and potential complications to make an informed decision about their care. This cross‐sectional study evaluated the informed consent process for major orthopaedic surgeries at a tertiary hospital in Nigeria. A self‐administered questionnaire was used to collect data from 120 adult participants. Results showed that many patients do not read the consent form before signing it, and surgeons do (...) not adequately explain the alternatives to surgery, potential risks, and available anaesthetic options. Higher‐educated patients are more likely to read the consent form. Surgeons performed well in explaining the nature of the condition and prognosis, the procedure's potential benefits, and answering patients' questions. The study emphasises the need to improve the informed consent process to ensure patients understand and can make rational decisions about their healthcare. (shrink)

Many fields of study have shown that group discussion generally improves reasoning performance for a wide range of tasks. This article shows that most of the population, including specialists, does not expect group discussion to be as beneficial as it is. Six studies asked participants to solve a standard reasoning problem—the Wason selection task—and to estimate the performance of individuals working alone and in groups. We tested samples of U.S., Indian, and Japanese participants, European managers, and psychologists of reasoning. Every (...) sample underestimated the improvement yielded by group discussion. They did so even after they had been explained the correct answer, or after they had had to solve the problem in groups. These mistaken intuitions could prevent individuals from making the best of institutions that rely on group discussion, from collaborative learning and work teams to deliberative assemblies. Construction process stages are argued to be vulnerable to the prevalence of corrupt practices. However, the validity of this argument has not been empirically explored in the extant literature of construction management. Therefore, this study examines the stages of the construction process susceptibility to corruption and its most prominent forms of corrupt activities. A total of forty-four project-related professionals were involved in an expert survey to assess such susceptibilities and the criticality of the identified corrupt activities at each stage. A (...) comparative study of expert views from developing regions against experts from developed regions is conducted. Expert scoring results revealed that three stages are most susceptible, namely: project execution, pre-qualification and tender stages. Such results were confirmed by application of the Mann–Whitney U test statistics tool, showing wide disparities in seven out of eleven identical stages. This study is intended to incite polemic discussions and greater empirical, evidence-based research from scholars in both developed and developing countries. This study adds to the extant literature corruption-related works on the construction process through deeper understanding of the dynamic nature of corrupt practices involved in the stages of the construction process in developing countries. Practically, it intends to offer a veritable plethora of information on the critical stages of the construction process for industry practitioners, policymakers and anti-corruption bodies to careen their attention towards the fight against corruption. L'oeuvre du philosophe Paul Gilbert, jésuite belge professeur de métaphysique depuis vingt-cinq ans à l'Université Grégorienne, est considérable et mérite d'être mieux connue. Après avoir étudié les écrits de saint Anselme (Dire l'ineffable, 1984), Paul Gilbert a questionné la métaphysique classique, sous l'influence de la philosophie réflexive (La Simplicité du principe, 1994). Il a ensuite souligné les chances offertes à la réflexion fondamentale par l'analogie, thème classique mais oublié (La Patience d'être, 1996, et Sapere e sperare, 2003). Plus récemment, il (...) a abordé la question de la violence, ce mal- être si commun (Violence et compassion, 2009). En 1997 déjà, son travail a été récompensé du prix Cardinal Mercier de l'U.C.Louvain-la-Neuve. Durant de nombreuses années, Paul Gilbert a été professeur invité à l'Institut catholique de Paris. A l'occasion de son éméritat dans cette institution, un colloque y a été organisé. Dans leurs communications, S. Bonanni, Ph. Capelle-Dumont, S. D'Agostino, E. Gabellieri, J. de Gramont, 1. Malaguti, R. Repole et E. Tourpe reprennent et développent l'élaboration de la pensée de Paul Gilbert. Despite the proliferation of studies on corporate social responsibility (CSR), there is a lack of consensus and a cardinal methodological base for research on the quality of CSR communication. Over the decades, studies in this space have remained conflicting, unintegrated, and sometimes overlapping. Drawing on semiotics—a linguistic-based theoretical and analytical tool, our article explores an alternative perspective to evaluating the quality and reliability of sustainability reports. Our article advances CSR communication research by introducing a theoretical-cum-methodological perspective which provides unique insights (...) into how to evaluate the quality of CSR communication. Particularly, we illustrate the application of our proposed methodology on selected U.K. FTSE 100 companies. Our two-phased analysis employed the Greimas Canonical Narrative Schema and the Semiotic Square of Veridiction in drawing meanings from selected sustainability/csr reports. In addition, we present a distinctive CSR report quality model capable of guiding policy makers and firms in designing sustainability/csr reporting standards. (shrink)

Emmanuel Lévinas (1906-1995) zählt nicht nur zu den wichtigsten Ethikern im 20. Jahrhundert. Vor allem entwirft er einen anderen Anfang der Ethik, die nicht auf der gesellschaftlichen Ebene oder als grosse Idee und Erzählung entsteht. Ethik entspringt vielmehr in der konkreten Zwischenmenschlichkeit, wenn man vom Anderen in die Verantwortung gerufen wird - und zwar durch die Verletzlichkeit seines nackten Gesichtes wie durch die Anrede. Die ethische Beziehung verdankt sich dabei nicht etwa der Gleichheit, der Nähe oder der Geschwisterlichkeit, sondern (...) der Andersheit des Anderen, seiner Ferne und vor allem seiner Fremdheit, die sich nicht hintergehen lassen. Damit gründet Lévinas die Gesellschaft nicht nur auf die Zwischenmenschlichkeit, sondern auch auf die Pluralität. So wenig wie die Ethik universelle Ansprüche erheben kann, lässt sich Gerechtigkeit als ein allgemeines Prinzip entwerfen. Vielmehr muss sie den Individuen in deren unendlicher Andersheit gerecht werden. In dieser Unendlichkeit blitzt im nackten Gesicht das Antlitz Gottes auf, denkt Lévinas aus der jüdischen Tradition heraus. Das lässt sich auch rein säkular verstehen, dass alle Menschen anders sind. Sie als Gleiche zu behandeln, unterwirft sie totalen politischen Ansprüchen, macht sie zu gehorsamen Untertanen. In Auseinandersetzung mit Sartre entwickelt Lévinas eine individualistische Ethik der Verantwortung, die jeden Menschen betrifft, indem sie aus der Zwischenmenschlichkeit heraus die Mündigkeit konstituiert. So verfolgt der Einzelne nicht primär seine Interessen, sondern übernimmt Verantwortung für den Anderen: Die Wende der Ethik im 20. Jahrhundert - von Sartre, de Beauvoir und Lacan inspiriert, von Derrida und Butler fortgeschrieben, bestehen zudem Parallelen zu Arendt und Foucault. (shrink)

En este artículo se exploran algunas de las relaciones entre lenguaje y subjetividad presentes en el pensamiento de Emmanuel Lévinas, principalmente, en sus obras Totalidad e infinito y De otro modo que ser. Asimismo, se expone cómo, para Lévinas, la subjetividad y el lenguaje se implican mutuamente para cuestionar la primacía del discurso ontológico e idealizante en la tradición filosófica. Interesovace me klasifikacija nekih figura nasilja iz razlicitih perioda Hegelovog zivota i njihovi tragovi u Levinasovim tekstovima pocevsi od teksta 'Libert? et commandement' iz 1953. godine. Analiza slavne Hegelove analogije iz njegove Rechtsphilosophie o suverenosti i organizmu, odnosno citanje nekih paragrafa njegove Naturphilosophie, treba da objasne vezu izmedju totaliteta i (...) nasilja, kao i Levinasovu 'ontologiju kao alergologiju' odnosno Derridinu autoimunologiju. Deconstruction both by its friends and enemies has come to be associated with a set of cliches that completely misunderstands its ethical aspiration. It is particularly within the field of law that we can see the ethical force of deconstruction, and also illuminate its concrete and practical importance. In The Philosophy of the Limit Drucilla Cornell examines the relationship of deconstruction to questions of ethics, justice and legal interpretation. She argues that renaming deconstruction "the philosophy of the limit" will allow (...) us to be more precise about what deconstruction actually is philosophically and hence to articulate more clearly its significance for law. Cornell explores the ethical and juridical significance of the so-called postmodern rebellion against metaphysics. A shared ethical rebellion links philosophers as different as Theodor Adorno, Jacques Derrida, Jacques Lacan, and Emmanuel Levinas. Together they present a new ethical configuration, new in its difference from both the critical social theory of J$u$urgen Habermas and the analytic jurisprudence of Nagel and Rawls. A key aspect of this newness is the centrality given to the relationship between questions of ethics and sexual difference. Cornell argues that the appeal of Lacan's analysis to feminists is that it helps to explain the profound hold the gender hierarchy has over Western culture, including its theories of political transformation. Under a Lacanian analysis the law of gender identity will be replicated in the laws of an existing legal system. This means that we cannot hope to sustain legal reforms unless the gender hierarchy is challenged. Cornell examines Derrida's position on the significance of the gender hierarchy in philosophy and explores its ethical and political importance. Derrida's intervention against legal positivism has important implications for the legal reforms necessary to protect marginalized groups. His emphasis on the limit, she argues, is crucial to thosewhose well-being and very lives may depend on legal transformation, women and homosexuals, for example. In an important contribution to legal philosophy, Cornell explores the affinities of Derrida's writings with recent liberal analytic jurisprudence. She also explores the differences. Comparing Rawls's and Derrida's accounts of justice, she argues that Derrida gives greater attention to the necessary utopian moment in his insistence on maintaining the divide between law, established norms, and justice. Cornell's focus on the importance of the limit and the centrality of the gender hierarchy allows her to offer a view of jurisprudence different from both critical social theory and analytic jurisprudence. As we watch the long-fought-for civil rights of women systematically overturned, we have reason to think about how the connections she makes shed light on an underlying truth of our social, political, and legal reality. Reasoning research suggests that people use more stringent criteria when they evaluate others' arguments than when they produce arguments themselves. To demonstrate this “selective laziness,” we used a choice blindness manipulation. In two experiments, participants had to produce a series of arguments in response to reasoning problems, and they were then asked to evaluate other people's arguments about the same problems. Unknown to the participants, in one of the trials, they were presented with their own argument as if it was (...) someone else's. Among those participants who accepted the manipulation and thus thought they were evaluating someone else's argument, more than half rejected the arguments that were in fact their own. Moreover, participants were more likely to reject their own arguments for invalid than for valid answers. This demonstrates that people are more critical of other people's arguments than of their own, without being overly critical: They are better able to tell valid from invalid arguments when the arguments are someone else's rather than their own. Wiredu’s call for democracy by consensus is illustrated by his description of traditional African consensual rationality. This description contains the attribution of immanence to African consensual rationality. This paper objects to this doctrine of immanence. More importantly, the doctrine of immanence has led to the attribution of pure rationality to traditional African consensual practices. With reference to Aristotle’s three components of persuasion, I object to deliberation as purely rational and impervious to extraneous factors. I further argue that it is because (...) deliberation is not always perfectly rational that the process of consensus can suffer three forms of social conformity: conformity to dominant players, to numerical opinion majority, and to group-centrism. These forms of conformity mean that a consensus task order could lead to decisions of more inclusive value, but not necessarily decisions of more epistemic value. The concept of agonistic inquiry is employed to tackle what I see as the dangers of conformity and complacency in the project of inclusivity, and this is to strike a crucial balance between too-consensual and purely adversarial forms of deliberation. This book provides an introduction to the emerging field of continental philosophy of religion by treating the thought of its most important representatives, including its appropriations by several thinkers in the United States. Part I provides context by examining religious aspects of the thought of Martin Heidegger, Emmanuel Levinas, and Jacques Derrida. Christina Gschwandtner contends that, although the work of these thinkers is not apologetic in nature, it prepares the ground for the more religiously motivated work of more recent (...) thinkers by giving religious language and ideas some legitimacy in philosophical discussions. Part II devotes a chapter to each of the contemporary French thinkers who articulate a phenomenology of religious experience: Paul Ricoeur, Jean-Luc Marion, Michel Henry, Jean-Louis Chrétien, Jean-Yves Lacoste, and Emmanuel Falque. In it, the author argues that their respective philosophies can be read as an apologetics of sorts--namely, as arguments for the coherence of thought about God and the viability of religious experience--though each thinker does so in a different fashion and to a different degree. Part III considers the three major thinkers who have popularized and extended this phenomenology in the U.S. context: John D. Caputo, Merold Westphal, and Richard Kearney. The book thus both provides an introduction to important contemporary thinkers, many of whom have not yet received much treatment in English, and also argues that their philosophies can be read as providing an argument for Christian faith. According to Wiredu, the Akan profess secular esteem rather than religious worship to supra-natural beings, who they perceive in an empirical sense. He backs this up by re-reading what he sees as the Akan general ontology in a way that denies them of the concepts of the supernatural, the transcendental, the mental, the spiritual, and an ontologically distinct mind. At the end of denying the three criteria of worship as well as all of these other concepts which might otherwise be (...) available to the Akan, one might struggle to find any evidence that the Akan even had a religion. I dispute this secular reading, and I more generally demonstrate that the characterizations of the Akan attitude to divinity as non-worshipping, non-supernatural, non-transcendent, and non-spiritual, are either conceptually flawed, factually incorrect, or both. L’argument de base de cet article est que le débat consensuel n’a pas été une notion très significative jusqu’à présent parce que le consensus n’a pas été étudié de manière approfondie en tant que concept et que la délibération n’a pas été étudiée précisément en termes de sa propension à parvenir à un accord commun. En particulier, la délibération et les problèmes qui en découlent n’ont pas été classées en plusieurs niveaux afin d’exposer les différents défis qui se posent lorsque (...) l’on tente de parvenir à un accord et les types d’approches délibératives impliquées dans chaque catégorie. In his plea for consensual democracy in Africa, Kwasi Wiredu recommends unanimity about what is to be done, not what ought to be done, or unanimity on action rather than unanimity of values, beliefs and opinion. I caution the use of this procedural instrument by showing that some issues are so value-laden that a group decision cannot be value-neutral. It may sometimes be more productive to entertain value differences to keep them from going underground and becoming dangerous. However, the ability (...) to locate some common interest or ground seems to be crucial for such value confrontation. (shrink)

Kant’s emphasis on the immorality of lying even to a murderer at the door who is asking about a victim hidden inside has drawn criticism ever since. The example originally given by Constant has been read as the thread of morality by totalitarian ruthlessness. In order to defend the importance of Kant’s moral philosophy, many critics have tried to update his position by taking into account the threat of modern totalitarianism. Nonetheless, this article tries to argue that Kant is right, (...) especially since the rise of post-truth politics. Sincerity towards oneself and towards others remains the basis of democracy: we have to admit what seems to be the truth regardless of our feelings about it. (shrink)

Prevailing literature argues that arguing is the only appropriate mode of deliberation. The literature acknowledges bargaining, story telling, and other forms of communication, but is unwilling to describe these as deliberation, properly speaking. The claim is that describing them as such would amount to concept stretching. In this article I argue that arguing exhausts neither the legitimate modes of deliberation nor the modes for effective deliberation. To do this I delineate two basic categories of issues we normally deliberate upon, and (...) demonstrate that arguing is more appropriate for one category, not so appropriate for the other. (shrink)

The demand for more transparency is hardly ever questioned. When it is, it is generally questioned in the name of a protection of privacy. In a traditional liberal understanding, there is a non-alienable “right to privacy” (Warren/Brandeis, 1890). Many political struggles, however, involved ignoring such boundaries, and making public things that were meant to remain private (domestic violence, gender oppression, child abuse etc.). While holding that the distinction between private and public is necessary, it must remain mobile and subject to (...) renegotiation. Civil inattention highlights the importance of disregarding: disregarding what others we share the same public space with do, as long as it is not of public relevance; and disregarding such rules of privacy if a violation of basic human rights is taking place, in order to make such behaviour public. In some cases, disregard and ignorance can thus be a moral virtue. (shrink)

« C’est une question de point de vue… » On associe aujourd’hui la perspective à l’individualisme, à l’affirmation d’une vérité privée et indépassable. C’est oublier la tradition de la perspectiva communis, celle qui fait de la perspective le vecteur d’un horizon commun. Au croisement de la science, de l’art et de la philosophie, le livre exhume une tradition que l’on se doit de redécouvrir : le point de vue, ce n’est pas seulement ce qui divise, c’est aussi ce qui se (...) partage. Au lieu d’incriminer le perspectivisme d’avoir fait le lit de la post-vérité, et de la perte d’une référence à un monde réel, il est temps de retrouver en quoi la perspective n’est pas qu’une affaire de relativisation, mais de réalisation. C’est à la perspective que nous devons notre perspicacité : « à travers » – voilà le mot-clé pour comprendre son opération. Une mise en regard d’enjeux anciens et contemporains, où s’entrecroisent les arts visuels, l’architecture, la phénoménologie et l’anthropologie sociale. Autant de manières de faire l’éloge d’une perspective qui se décline invariablement au pluriel. (shrink)

There have been two parallel views regarding the role of voting in deliberation. The first is that deliberation before the fabrication of balloting was completely devoid of voting. The second is that voting is, not just part of deliberation, but is standard to deliberation. I argue in this article that neither of these views is correct. Implicit voting has always existed across time and space but only as a last resort in the event of a failure of natural unanimity. What (...) is relatively modern is the establishment of what I call explicit voting, namely, balloting, outside deliberation and often without deliberation. I also distinguish between natural and artificial unanimities, and clarify that artificial unanimities are products of implicit voting. I demonstrate these clarifications with some examples of deliberation. I deploy these clarifications to rid a certain debate of confusion regarding the precise role of voting in consensual deliberation. (shrink)

In the first, it tries to assess the exact meaning of the ‘pictorial’/’iconic turn’, and (re)places it into the context of Anglo-American visual studies and German Bildwissenschaften. It the second, it addresses the famous claim by the philologist Ernst Robert Curtius that ‘image sciences are easy’ by advocating for three ‘turns of the screw’ to make visual studies more difficult: a shift from iconology to symptomatology, a shift from extensive to intensive and a shift from the indicative to the subjunctive. Dialectics, especially Engels’s dialectics of nature, is nowadays mostly held in low esteem, even by Marxist scholars because of its Stalinist dogmatisation over the past century. The aim of this comparative review is to show some stakes and prospects, in Marxism and for Marxism, of the debate: the two reviewed books show how the dialectics of nature could, and why it should be considered in a renewed materialist approach to the natural sciences, and provides the reader with complementary outline from (...) the cognitive sciences to physics, via mathematics. Recent debates about aesthetics are characterized by a partly intentional, but also partly involuntary, vagueness. Whether it be aestheticisation or anesthetisation, articisation or desartification: what is upheld or deplored under one and the same label in fact designates rather different things. The paper makes a suggestion as to how the field could be reorganized. Taking heed of what political theory discusses as the “political difference” between “politics” and “the political”, the aim is to examine what would be gained by working (...) with an “aesthetic difference” that does not straightforwardly equate “the aesthetic” with “art”, and “the aesthetic” with the totality of sensuous-aisthetic processes. An aesthetic thinking would then amount to a thinking that does justice to these inner polarities and remains faithful to the ambiguity of its objects. (shrink)
